DMCA
Effective Date: December 1, 2025
At Arson Theory, we respect the intellectual property rights of creators and comply fully with the Digital Millennium Copyright Act (DMCA) as a U.S.-based platform providing music distribution, publishing administration, and rights management services.
This Policy explains how we handle copyright infringement claims for content appearing on our platform or distributed through our Services. As we serve global creators, we also align with the EU Copyright Directive and other relevant international standards where applicable.
⸻
1. Reporting Copyright Infringement
If you believe that material available on arsontheory.com, within our dashboard, or distributed via our Services (e.g., tracks, artwork, metadata) infringes your copyright, you may submit a formal DMCA notice to our Designated Agent at:
Email: dmca@arsontheory.com
Your notice must include the following:
(i) Your full legal name, mailing address, telephone number, and valid email address;
(ii) A detailed description of the copyrighted work you believe has been infringed;
(iii) The exact location or URL of the infringing material (e.g., link to the content, artist profile, or release page);
(iv) A good-faith statement that you believe the disputed use is unauthorized by the copyright owner, its agent, or the law;
(v) A statement made under penalty of perjury that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf; and
(vi) Your physical or electronic signature.
By submitting a notice, you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which you reside (or in Los Angeles County, California, if outside the U.S.).
Upon receipt of a valid notice, we will:
(i) Review and verify the claim;
(ii) Remove or disable access to the allegedly infringing material; and
(iii) Notify the user who uploaded or submitted the content.
⸻
2. Submitting a Counter-Notice
If your content was removed or access was disabled and you believe this was an error or misidentification, you may submit a Counter-Notice to the same Designated Agent at dmca@arsontheory.com.
Your counter-notice must include:
(i) Your full legal name, address, and contact information;
(ii) Identification of the material that was removed or disabled and the location where it appeared before removal;
(iii) A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
(iv) Consent to the jurisdiction of the U.S. Federal District Court for your district (or Los Angeles County, California, if outside the U.S.); and
(v) Your physical or electronic signature.
Upon receipt of a valid counter-notice, we may restore the material within 10 to 14 business days unless the original complainant notifies us that they have filed a legal action seeking to restrain such restoration.
⸻
3. Repeat Infringer Policy
Arson Theory maintains a strict repeat infringer policy in accordance with the DMCA.
(i) Accounts associated with multiple valid infringement notices may be suspended or permanently terminated.
(ii) We monitor dashboard activity and platform submissions to detect repeated violations.
(iii) Users terminated under this policy may lose access to all associated Services and earnings.
⸻
4. Anti-Fraud and Rights Protection Measures
In addition to DMCA compliance, Arson Theory enforces strong anti-fraud and rights-integrity measures to protect creators and partners.
(i) Fraudulent activities such as fake streams, unauthorized uploads, or metadata manipulation are strictly prohibited.
(ii) Verified reports of fraud or rights abuse may result in immediate account suspension or termination.
(iii) Suspected fraud can be reported to clientservices@arsontheory.com for investigation.
(iv) For users within the European Union, we align with the EU e-Commerce Directive regarding intermediary liability and safe-harbor compliance.
⸻
5. Global Copyright Compliance
Arson Theory’s copyright procedures are based on:
(i) U.S. DMCA provisions (17 U.S.C. §512) for notice and takedown processes;
(ii) EU Copyright Directive (2019/790) for content-sharing platforms; and
(iii) Additional local copyright frameworks where applicable to distributed content.
